PT:U Personal Training - Terms and Conditions

 

1. Introduction

1.1 What These Terms Cover: These terms and conditions govern the provision of personal training, coaching, and related services by PT:U Personal Training Ltd ("PT:U," "we," "us," or "our") to you ("the client").

 

1.2 Services: The term "Services" refers to any of the following offerings, as agreed in writing:

   - Personal Training: One-to-one or one-to-two sessions at PT:U gym, including nutritional advice.

   - Virtual Training: One-to-one or one-to-two sessions via the PT:U app, including nutritional advice.

   - Group Training: Group sessions conducted by PT:U trainers.

   - Online Personal Training: One-on-one coaching delivered through PT:U exercise programs and nutritional guidelines.

   - The term "Session" refers to any personal, virtual, or group training session provided by PT:U.

 

1.3 Why You Should Read These Terms: Please read these terms carefully. They explain who we are, how we provide services, how changes or cancellations work, and other important information.

2.3 How We Contact You: We may contact you via phone (including WhatsApp), email, or post using the details provided when you sign up.

 

3. Contract Formation

3.1 Acceptance of Orders: A contract is formed once we confirm your booking and/or process payment.

 

3.2 If We Cannot Accept Your Order: If we are unable to provide services, we will notify you and issue a refund if applicable.

 

4. Health & Safety

4.1 Health Questionnaire: You confirm that you have completed the PT:U health questionnaire honestly and accurately. If incomplete or inaccurate, we reserve the right to refuse or discontinue services.

 

4.2 Client Responsibility:

   - You confirm that you are medically fit to participate in physical training.

   - You agree to inform us of any changes in your health.

   - PT:U strongly recommends consulting a qualified medical professional before starting training.

 

4.3 Liability Waiver:

   - Participation in training involves inherent risks, including injury, illness, or death.

   - You assume all risks and release PT:U, its employees, and trainers from liability, except in cases of negligence.

 

4.4 Nutritional Advice Disclaimer:

   - All nutritional guidance provided is for general body composition goals and should not be considered medical advice.

   - Clients should seek medical advice before making dietary changes.

 

5. Payment & Non-Payment

5.1 Payment Terms: Payment must be made prior to receiving services.

 

5.2 Late Fees & Debt Collection:

   - If payment is not received within 7 days of the due date, a £20 late fee will apply.

   - If payment is still outstanding after 14 days, services will be suspended.

   - If unpaid after 30 days, the account may be referred to a debt collection agency, incurring additional costs.

 

6. Session Expiry, Cancellations & Refunds

6.1 Session Expiry:

   - Sessions must be used within 3 months of purchase.

   - Monthly packages must be used within the calendar month.

 

6.2 Session Cancellations:

   - Cancellations with less than 24 hours’ notice will be charged in full.

   - To avoid charges, written proof of cancellation with more than 24 hours’ notice is required.

 

6.3 Extraordinary Circumstances Refund Policy:

   - Refunds may be granted in exceptional cases, including:

     - Serious illness or injury (doctor’s note required)

     - Pregnancy

     - Bereavement

   - If a refund is granted for partially used services, a 50% refund on remaining sessions applies, provided at least 50% of the sessions remain unused.

 

6.4 Transferring Sessions:

   - Unused sessions may be transferred to another person upon written request.

 

7. Changes to Services

7.1 Minor Adjustments: We reserve the right to make reasonable changes to services, including trainer reassignment or adjustments due to health and safety concerns.

 

7.2 Suspension of Services: Services may be suspended for maintenance, regulatory compliance, or facility issues. Clients will be notified in advance where possible.

 

8. Force Majeure (Unforeseen Events)

8.1 If PT:U is unable to provide services due to unforeseen circumstances (e.g., pandemic, government restrictions), session expiry dates will be extended, but refunds will not be issued.

 

9. Additional Service Policies

9.1 Availability of Facilities: We cannot guarantee that all PT:U gym facilities will always be available due to maintenance or equipment issues.

 

9.2 Failure to Attend Sessions: If you fail to attend sessions or do not contact us for more than 30 days, we may reallocate your trainer and you may lose preferred session slots.

 

9.3 Use of Sessions: All monthly package sessions must be used within the month of purchase, and block-purchased sessions must be used within 3 months.

 

9.4 Missed Sessions Expiry: If sessions are not used within 3 months from the purchase date and you do not contact us, they will be forfeited without a refund.

 

10. Intellectual Property

10.1 Use of Materials:

   - All workout plans, guides, videos, and related content remain intellectual property of PT:U.

   - Clients may not reproduce, share, resell, or distribute PT:U materials without permission.

 

11. Complaints & Dispute Resolution

11.1 How to Raise a Complaint:

   - Contact us at info@pt-u.co.uk or speak to a member of staff.

   - We will aim to resolve issues within 14 business days.

 

11.2 Mediation:

   - In the event of a dispute, both parties agree to seek mediation before pursuing legal action.

 

12. Liability & Business Use

12.1 Limited Liability:

   - We are not liable for indirect losses such as loss of profit, business interruption, or loss of business opportunity.

 

12.2 Total Liability Cap:

   - Subject to Section 4.3, PT:U’s total liability will not exceed 150% of the amount paid by the client for services in the last 12 months.

 

13. Privacy & Data Protection

13.1 How We Use Your Information:

   - To provide and manage services.

   - To process payments.

   - To inform you about services unless you opt out.

 

13.2 GDPR Compliance:

   - Personal data will be stored securely and only used for service-related purposes.

   - Clients may request data deletion at any time.

 

14. General Terms

14.1 No Third-Party Rights: This contract is between you and PT:U; no third party has rights under it.

 

14.2 Severability: If any part of these terms is deemed unenforceable, the remaining provisions will remain in force.

 

14.3 Governing Law: These terms are governed by English law.
